‘They Don’t Want This to Happen’

Senate Democrats intend to deny cloture on the Clarity Act. The reason seems to be no visible progress from the White House on a bipartisan ethics deal that Democrats have made the price of their votes on the digital asset framework.

Senators have already sent a bipartisan ethics text to the White House, but with no response, the procedural vote is set to fail. Sen. Ruben Gallego (D-AZ), who helped craft the ethics compromise alongside Sen. Thom Tillis (R-NC), did not hide his frustration, adding:

We are clearly here, trying to engage in a constructive manner. At this point, if they’re not engaging, it’s telling me that they don’t want this to happen.

The ethics dispute has dogged the bill for weeks and Democrats want enforceable limits on federal officials profiting from digital assets while in office (language aimed squarely at President Trump’s family crypto ventures). Subsequently, they have dismissed the provision in the current 616-page text as insufficient.

Thune Digs In as the Clock Runs

Senate Majority Leader John Thune (R-SD) is still digging in on plans to hold a procedural vote before the chamber leaves town, but the mechanics are getting tight. Fox Business correspondent Eleanor Terrett reported that Thune did not file cloture on the motion to proceed Tuesday evening, pointing to procedural matters around the continuing resolution (though she noted that not having the votes “likely also factored in”).

Because Senate rules require an intervening day between filing cloture and the initial vote, every day without a filing pushes the bill closer to the Friday recess with no path to passage. Republicans hold 53 seats, meaning roughly seven Democratic votes are needed to reach the 60-vote threshold and the bill currently has none.

The pressure campaign from the bill’s supporters has not let up. Sen. Cynthia Lummis (R-WY) urged Senate Democrats this week not to block the bill, calling it legislation that protects consumers and keeps the crypto industry in the U.S. Industry advocates have flooded Congress with more than 1 million constituent contacts backing the framework.

Markets Cut the Odds

Crypto markets are already pricing in the dysfunction as Polymarket odds on the Clarity Act being signed into law in 2026 slid from 27% to just 23% this week, espeically after the Senate skipped the bill on Monday’s agenda. Bitcoin, which bulls hoped would ride a regulatory breakthrough back above its highs, has instead spent the week chopping near $64,000.

If Thune files cloture on Wednesday, a vote could still happen before the Friday deadline; if the vote fails or never comes, the bill is parked until at least September, when the ethics standoff resumes with midterm politics bearing down.
