The ruling, while not immediately enacting Trump’s birthright citizenship directive, curtailed the power of judges to issue nationwide injunctions against presidential policies, thereby shifting the balance of power between the federal judiciary and the presidency.
The Supreme Court directed lower courts that had blocked the directive to re-evaluate the scope of their orders. Importantly, the ruling did not address the legality of the policy itself, which is a component of Trump’s stringent immigration stance.
