Kim Ogg, the former Harris County District Attorney, is releasing previously unreleased evidence related to the Jocelyn Nungaray case. The case gained national attention due to the undocumented status of the suspects, Franklin Jose Pena and Johan Jose Rangel Martinez, who are Venezuelan nationals possibly linked to gangs. LiveNOW’s Christina Evans is speaking with Abigail Dye from Fox 26 Houston as more details continue to emerge.
The former District Attorney says her office thoroughly reviewed the evidence before deciding to pursue the death penalty in this case. “Authorities had no idea of their past behavior – if they had criminal charges in Venezuela or another country – that makes it hard to determine if someone is going to be a future danger,” she said.
“What we learned over the course of the investigation was that one of the suspects, Pena, had been involved in a prior sexual assault,” said Ogg. She says an American woman was on vacation when Pena attacked her. “It happened in Costa Rica. It happened to an American citizen who came forward with that information after their pictures were shown on national television,” the former Harris County District Attorney said.
