At the center of the lawsuit are 2,396 videos downloaded via BitTorrent from IP addresses belonging to Meta. The company claims these infringements have been ongoing since 2018.

It is alleged that this content was used to train the artificial intelligence to mimic human movements more realistically. The plaintiff company is demanding statutory damages of up to $150,000 for each infringement. This means the total value of the lawsuit could reach up to $359 million. The case is not limited to monetary compensation; Strike 3 is also demanding that Meta delete all of its copyrighted content and refrain from using it in the future.
This lawsuit once again brings to light the legal uncertainty surrounding the use of copyrighted materials as training data by AI companies. In similar cases previously brought by artists and authors, courts have rendered different verdicts. However, what makes this case different is the direct and provable act of copyright infringement through the alleged unauthorized downloading and distribution of content via BitTorrent. This situation could change the course of the lawsuit and set a precedent in the AI industry.
