A Vote “This Week,” Again

Thune’s latest comments repeat a promise he has made and walked back before. As recently as July 23, the majority leader told reporters he did not expect the Digital Asset Market Clarity Act, the bill’s formal name, to reach the floor before the summer recess, citing insufficient votes.

Now days later, he has reversed course, saying the Senate would keep working through its packed pre-recess calendar specifically to get the crypto market-structure bill done. “We have a bunch of stuff that we have to finish, and we’ll just stay here until we finish it,” Thune said, folding the CLARITY Act into a broader list of unfinished Senate business rather than treating it as a standalone priority.

Furthermore, Bitcoin.com News reported this week that the Senate skipped a scheduled floor vote on Monday, leaving only four legislative days before the chamber breaks on August 7 and does not return until September 14. Missing that window would not kill the bill outright, but it would push a vote into the fall, when midterm-year politics tend to swallow legislative bandwidth that isn’t already locked in.

Why the Clock Is so Tight

The CLARITY Act needs 60 votes to clear the Senate under normal procedure, and Republicans control only 53 seats, meaning at least seven Democrats have to cross over. Also, the White House and Senate Republicans reached an agreement in principle on ethics language in late July, with Trump personally signing off on the compromise, but Democrats say they have not yet seen the actual legislative text, and some argue the language as described would still preserve pathways for Trump to keep profiting from his family’s crypto ventures.

Treasury Secretary Scott Bessent has described the legislation as being at the “one-yard line,” but even then Galaxy Research’s own odds are just 30 percent (as of this week). Prediction markets are similarly split, with JPMorgan pricing passage odds around 37 percent and Polymarket bettors closer to 26 percent.

What Happens If the Senate Misses the Window

More than 1,200 tech companies have pushed the Senate to move quickly, with trad-fi giants like Grayscale publicly urging a vote before recess, and asset manager Charles Schwab repeatedly referring to the bill as a “fundamental catalyst” for institutional crypto adoption.

If that wasn’t enough, a coalition of 134 bank leaders has separately raised alarms about specific provisions they want changed before final passage, showing that the CLARITY Act is not simply the crypto industry versus skeptics but a multi-sided negotiation over exactly which rules apply to which market participants.

If Thune’s promise holds and the Senate does find a path to 60 votes this week, the CLARITY Act would become the first comprehensive federal market-structure law for digital assets, splitting oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission depending on how a given token is classified.
